will have before it the whole issue of proposition from california and the issue of same-sex, it always has the potential to go after roe v. wade. we have three or four justices now in their 70s, one in poor health. it seems to me hard to argue that the next president, if it's the same president or the next president, are going to have an opportunity to pick supreme court nominees, and they will have an impact on roe v. wade it seems to me. >> across a range of issues, chris. i don't want to diminish roe v. wade but you pointed out the gay rights decisions. there are a lot of race decisions before the court on affirmative action and other race related matters. all social policy. there isn't a more important branch of government when it comes to social policy than the supreme court. it's always true. it's almost the single biggest thing that's at stake in any presidential election and this one particularly because the age of the justices, as you pointed out. the next president might get to appoint three supreme court justices in the next four years and that could alter the balance

happened in benghazi. i want to bring in congressman karen bass from california. let me talk with you about the climate. speaker boehner seemed a bit more willing to at least discuss and put things on the table that maybe were not there before, specifically tax revenues. what is your feeling or sense as congressional leaders prepare to meet with the president per his invitation at the white house? >> i was encouraged by his tone. i thought his stone signaled compromise, however the devil is in the details. so he said he was open to revenue being increased through tax reform, but tax reform is extremely complicated and the fiscal cliff goes off at the end of december. we have to figure out what we'll do. the president and i would love to see tax reform, but what will we do in the mean time? the president said we need to extend the tax cuts for the middle class immediately, because that impacts 98% of americans and 97% of small businesses. so i think that's the action that we need to take immediately, and i'm hoping with boehner's tone that he would aagree to that. >> we have a comm

. you know, dianne feinstein, veteran democrat from california just reelected herself the other night, a veteran of the intelligence committee said she wished that president obama had not accepted petraeus' resignation, that he didn't need to leave office for an indiscretion of that kind. the president didn't immediately accept it, but ultimately he gave in to the logic that petraeus himself was emphasizing, which is it simply wasn't tenable for him to stay in the job having done what he did. and i think everybody is disappointed because petraeus's talents are recognized by people in both parties and have been for years. but he is -- he is paying a very, very stiff price for the mistake that he made. and the white house is simply going to have to roll with that. >> and there are a lot of folks, john harwood, this afternoon, especially out there on twitter and the blogosphere who are raising questions about all of this happening so close to the time he was set to testify next week, that closed door meeting on the hill regarding benghazi. >> everything we know about this so far is that
